After pulling you over, the officer may observe you for particular signs that would indicate that you were under the influence of alcohol or a controlled substance. He or she may make note of bloodshot eyes, slurred speech, the smell of alcohol, or similar indicators. If the officer still believes that you may be intoxicated, he or she may ask you to step out of the vehicle to perform field sobriety tests. The walk and turn and one leg stand are two examples of sobriety tests that an officer may have you perform. Depending upon your balance, statements made during the tests, coordination and ability to follow instructions, the officer may then arrest you for a Sanford DUI.

After a Sanford DUI Arrest

After your arrest, you will be asked to take a breath or blood test to determine your blood alcohol concentration. Refusal of these tests will result in the automatic suspension of your driver’s license, although you do have the opportunity to challenge this suspension at a DMV hearing.

If your blood alcohol level is .08% or greater, you will most likely be charged with DUI. However, you may be charged even with a blood alcohol level below the legal limit – if you are considered to have been “under the influence” of alcohol and/or drugs. That is, if your normal abilities were impaired due to alcohol or a controlled substance.
